What is a "Rape Shield"
I'm not here to insult anyones intelligence, but to merely try and educate, or bring to light some details that residents of Wetzel County and the surrounding areas are not aware of. I'm asking you to go to your favorite search engine and look up Rape Shield. Mine was Google. Fourth one down the list hit home for me. Check them all out. In a nutshell my upcoming trial August 31st in Wetzel County is in jeapordy because of this "rape shield". It is apparent that countless other innocent people in the U.S.A. become vitims themsleves because of the "rape shield". Our Sixth Amendment Right as citizens is to have a fair trial by jury. This is not possible when the jury can not hear both sides of the story? The Rape Shield in place protects the victim too much! The alleged victim or their stories are not always the truth, but damning evidence against the victim can not be heard because of the shield. I'm facing 50 years because of lies. What's the point of that Capedcrusader? Read the article in the Chronicle. It clearly states that they were deemed "grossly innapropriate" Deal with it! Also what it does not state along with many other things was that in having to explain some of it's content Mr Paul asked "do you use that kind of language with your kids?" Of course I said no! Why did I say no? I explained to him and the jury that "I respect my kids and they respect me and that they do not constitute the use of this languge, I was talking to her in the same manner in which her partnts talk to her and in a languge I figured she would understand" At the time of writting the message to her she was being mean to not just me but my kids as well, which whom she had too much exposure to. I did not want her negative additude around my kids! I was already judged by my peers once for this Capedcrusader, I need not be judged again. It's over now! Hey FVG, I can not say one way or another if anything ever happened to the girl at all. But if anything ever did "IT WAS NOT BY ME!" All I know for sure is that the situations she puts herself in coupled with the fact that her parents can not control her at all... Well you can draw your own conclusions on that. I was asked on the stand " how would you feel about a 42 year old man talking my 14 year old daugher in the way I was communicating with her" My reply: "If the person was trying be a possitive influence in her life much unlike her own parents are to her, chances are I would'nt even know about it. But comparing my daughter to that girl was like comparing apples to oranges. I have an active role in my childrens lives. Now you ask yourself did anything happen to her? The jury saw her and her family on the stand too! You get out of your kids what you put into them. My only crime was ever thinking I could help a very troubled girl. I can't save the

So, did anything actually happen to this girl? Was she violated by anyone? Did she make it up to get attention? Did she make it up because of a plot to try to get something from someone? To cover a boyfried's butt if she was actually pregnant? Does she need mental help, or a good *** beating?

I'm certainly here not to brag on the outcome of my trial. Although found not guilty I'm sure some folks out there are still going to question why this matter even came to light. All I can do at this point is to first thank Jeremiah Gardner from the Public Defender Corp. in Moundsville for his dilligent efforts in sifting through the lies against me to get to the truth!! Secondly the jury of my peers for listening for two days and using their heads to get to the right decision! Third The Honorable Judge Hummel for being fair. He runs an outstanding court room. One of which I never wanna be in again, at least not on the wrong side of the law! In short the elements were not nor were they ever there in either count. I know my nose it not any longer for what I said in the courtroom while on the stand. Can't be so sure of the alleged victim's nose! Yes Justice Did Prevail! Thanks to those of you who took the time to read any of these messages and careded either way!

See there Mr. Stewart. The justice system did what it was supposed to do. You were found NOT GUILTY by a jury of your peers. Guess those public defenders aren't that bad either.

Oh Charlie, I just heard from my brother what is going on with you! Im sooo sorry. I know deep in my heart you could not have done anything like this to anyone. Then when I heard who it involved... OMG do you remember what her mother's house was like back in the day when we all lived in town? Go figure! Sounds as though her daugter is doing the same kind stuff that she used to condone when we were around Sistersville! With any luck the jury will see what kind of a person her mother is. Then it should come as no suprise that the apple does not fall far from that tree! Good Luck and God Bless You My Friend! You are innocent I'm sure of it! I'll be praying for you!

I hope justice prevails, seems that the court appointed attorney would want to win this one to prove he can handle cases of this magnitude.

Yes, FVG as Angelinlc commented I have been divorced since Oct of 08 had been separated since Sept 07. I have three beautiful children ages 14, 7, and 6. I love them to death! One of the only reasons I was even affiliated with the family of the girl accusing me was that her mother and I were high school friends. Her oldest daughter babysat for me on occasion. Had I known that any of her kids (her youngest two daughters) were the juvinile deliquantes they are, I would not have taken my children around that apartment. I found out too late the hard way.

I'm sorry that I may sound a little testy when it comes to my posts. Please understand where I am coming from in this case. I do not want to lose any part of my life over lies. When in all what I did for this girl was try to be a friend to her when I thought she might need one. She came to me telling me things, because her parents are not certainly parents to her and I would listen to her. She confided in me many things I'm sure even some of her own friends may not know about her. I never once had any intentions of doing wht she has accused me of. The thought never crossed my mind!!! Yeah, I'm ticked off! What has this world come to? I weep for our younger generation! But if you stop and think about it, "where did they learn it?" I'm innocent pass it on!

I'm glad you all are talking about it. My goal here is to get Wetzel County talking about it outside the courtroom because from what I have been told by my attorney it that due to this Rape Shield she's gonna look like an angel on the stand. That could not be further from the truth. He is another pill for you all to swallow. I was in her life thanks to her mother who was a long-time friend of mine. The girl was mad at me because I was kind of seeing her mom off and on and she wanted me to be with her and I "turned her down"!!!! Then all of this comes down on me. By the way the girl is in HillCrest now! I hope that comes out in my favor!

Like catlover said... the burden is with the prosecution. And they have to prove to a jury beyond a resonable doubt. That means if there is doubt created by the defense, then they should be found not guilty. I would agree that on einnocent person in jail would be to many. But I cant beleave there is "countless" numbers of them in jail. Read this paper each week and see how any cases are dismissed. Then pay attention to the number who get probation as part of plea agreements. We dont read about very many jury trials, because they are rare. They are rare because it is hard to prove beyond a reasonable doubt to a jury.

He chose to have relations with a drug using minor with countless issues, did he expect something better to happen? Give me a break. Sounds like he got caught with his hand in the cookie jar.

While her past does not matter when and if she said no, it does matter in that if she's proven herself to be unreliable and immoral, chances are higher that she's lying when she accuses than someone that has a cleaner past. This is a hard question, again, rape is inexcusable, but so is lying about it. I'm glad I'm not on that jury.
